Russ’s Body Shop, LLC Harbor Beach Michigan – Limited Warranty Policy
1. Russ’s Body Shop, LLC warrants that all work preformed will be free from defects in materials and workmanship for the life time of the vehicle for the registered owner of the vehicle at the time of the repair, providing warrantee has signed the work order, has paid for all services rendered in full, and provided Russ’s Body Shop, LLC with proof of ownership of the vehicle / items repaired at the time of repair. If the product or services proves defective during the warranty period, Russ’s Body Shop, LLC, at its option, will:
(a.) Repair the defect by means of service only at Russ’s Body Shop, unless written permission from Russ’s Body Shop has been submitted to the warrantee authorizing another repair facility to perform the work, at no charge for parts or labor.
(b.) Replace the parts with a comparable product, which may be new or refurbished, providing the customer has completed the warranty request form supplied on request at Russ’s Body Shop, LLC.2. Russ’s Body Shop, LLC reserves the right to charge for service in exception cases.
Exceptions cases include, but are not limited to, abuse of any form to components repaired or replaced, or other components that may have a negative impact on components that were repaired or replaced by Russ’s Body Shop, LLC. Other exceptions are
(1.) any “natural disasters”, or acts of God, any damage resulting from illegal activity,
(2.) lack of proper maintenance as prescribed by OEM’s,
(3.) theft,
(4.) any other act in which workmanship or manufacturing defects were not the direct cause of failure.3. These warranties shall not apply to any defect, failure or damage caused by improper use or improper or inadequate maintenance and care. Russ’s Body Shop, LLC shall not be obligated under these following issues as well pertaining to warranties:
(a) To repair damage resulting from attempts by personnel other than Russ’s Body Shop, LLC representatives to install, repair or service the product unless directed by a Russ’s Body Shop,LLC representative.
(b) To repair an item that has been modified or integrated with other products when the effect of such modification or integration increases the time or difficulty of servicing the product or degrades performance or reliability.
(c) Damage, malfunction, or degradation of performance resulting from use of the product in an environment not meeting the operating specifications set forth in the user manual,
(d) Any circumstance listed in Part 2 of this warranty description.
(e) To repair damage, malfunction, or degradation of performance resulting from failure to properly prepare and transport the product as prescribed in published product materials
(f) To warranty repair this product after it exceeds the normal life span of the component in this warranty statement,
(g) To replace items that have been exhausted by normal wear and tear, abused, misused, or tampered with in any way;
(h) To install replacement items that are considered customer replaceable;
(i) Any repairs done due to existing rust. Because rust is a deterioration of metal, there are no guarantees to the longevity of any repairs done to rust affected areas. Warranty is limited to defects in the actual manufactures paint materials as prescribed by paint manufacturer. All reoccurring rust claims will be denied regardless of circumstance.4. In the maintenance of the product or service, Russ’s Body Shop, LLC may use new or equivalent to new parts, assemblies or products for equal or improved quality. All defective parts, assemblies, and products become the property of Russ’s Body Shop, LLC. Russ’s Body Shop, LLC will require the return of parts, assemblies and products to a designated Russ’s Body Shop, LLC Depot or the Russ’s Body Shop, LLC representative from which the part, assembly, or product was originally purchased. Returns and claims will be handled according to the current Russ’s Body Shop, LLC procedure.
5. Vinyl warranty is limited to the manufactures stated warranty periods. Russ’s Body Shop, LLC will provide customers with knowledge of warranty on all materials of vinyl, based on the brand of materials. Workmanship on vinyl is limited to workmanship at the time of the installation. Russ’s Body Shop, LLC will correct any improperly installed vinyl. All decisions on workmanship are at the sole discretion of Russ’s Body Shop, LLC. Failure on customer’s part to properly maintain vinyl, abuse, or defect in any way voids all warranties printed or implied on vinyl. Deterioration of vinyl due to weather, fire, theft, or any other condition other than normal wear and tear voids all warranty on vinyl.
6. Sandblasting / Refurbishment is based on materials used at the time of restoration. Because of the nature of sandblasting, the multiple options available for sandblasting and refinishing, the warranty is limited to the stated warranty from the manufacturer on the products that are used in each individual job.
Any service identified in the above list and provided by Russ’s Body Shop, LLC at the Customer’s request shall be invoiced to Customer at Russ’s Body Shop, LLC’ then current rates for parts and labor. Russ’s Body Shop, LLC reserves the right to cancel warranty at any time for any reason.
THE ABOVE WARRANTIES ARE GIVEN BY RUSS’S BODY SHOP, LLC WITH RESPECT TO THIS PRODUCT AND OR SERVICE AND ITS RELATED ITEMS IN LIEU OF ANY OTHER WARRANTIES, EXPRESS OR IMPLIED. RUSS’S BODY SHOP, LLC AND ITS VENDORS DISCLAIM ANY IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE OR ANY SIMILAR STANDARD IMPOSED BY APPLICABLE LEGISLATION. RUSS’S BODY SHOP, LLC' RESPONSIBILITY TO REPAIR, OR REPLACEMENT FOR DEFECTIVE PRODUCTS AND RELATED ITEMS IS THE SOLE AND EXCLUSIVE REMEDY PROVIDED TO THE CUSTOMER FOR BREACH OF THESE WARRANTIES.
This warranty gives you specific legal rights, and you may also have other rights that vary by state, province, or country.
TO THE EXTENT ALLOWED BY LOCAL LAW, EXCEPT FOR THE OBLIGATIONS SPECIFICALLY SET FORTH IN THIS WARRANTY STATEMENT, IN NO EVENT SHALL RUSS’S BODY SHOP, LLC AND ITS VENDORS BE LIABLE FOR ANY INDIRECT, SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES (INCLUDING LOSS OF PROFITS) WHETHER BASED ON CONTRACT, TORT, OR ANY OTHER LEGAL THEORY AND IRRESPECTIVE OF WHETHER RUSS’S BODY SHOP, LLC OR THE VENDOR HAS ADVANCE NOTICE OF THE POSSIBILITY OF SUCH DAMAGES.
